Wrecked my 2 month old CC

Hi folks,
I'm feeling the need to vent a bit. Hope y'all don't mind :)

So I was riding my 2 month old cross country with naught but 2500ish wonderful miles on it a little over a week ago. It was the last ride of the season and I was on my way home with the intent of winterizing it the following day. On the way I took an unfamiliar route to try and avoid heavy highway traffic and wound up on a downtown city street (not smart, I know). I was in a good riding state of mind though and paying attention to cross streets and traffic as I normally would. Next thing I know I'm on the hood of a car... My first thought was "did someone just pull out in front of me?" followed by some understanding that I had likely just been in an accident. The car (which I was still on top of) slowly rolled to a stop and I stood up. That's when I noticed the back pain and hobbled off the street to lean against a tree until the police came.

An ambulance trip and a few days in the hospital later I am in a back brace with a burst fracture in one vertebrae (plus some cuts and bruising). Fortunately I'm still walking and haven't sustained any nerve damage so far, so I'm very lucky on that account. I was wearing all my usual gear and the only piece that sustained damage was my jeans which were sliced through during the crash (no idea by what).

I learned afterwards from the police that the other driver said he didn't see me in his mirror and pulled out from a parked position on my side of the street wth the intention of making a u turn. I don't recall seeing any creeping car or turn signal, so he must have pulled out pretty darn quick. I always try to ride toward the center line just in case people pull out like that, but as he was making a u turn he covered the whole lane. To make matters worse he had no license and produced an insurance card for the car (not in his name) that was 2 years expired.

All in all I could have been a lot worse and I feel very fortunate for that. The bike is at the dealership getting an estimate for insurance. Unfortunately I don't have any pictures, but once j get some from the shop I'll post them up. Not sure about the prognosis, but I'm sure my local Vic mechanics will let me know.

Now to fight with my insurance about the medical bills... Always fun right? :)

Glad you're not more seriously hurt Jasum! Hopefully the battle with insurance will be as painless as possible. It's amazing how snowed in cagers are these days. I hope you have a speedy recovery and will be back on 2 wheels soon!

I should have mentioned, the back brace is only for 2-3 months. It's inconvenient, but better than bed rest! The doctor thinks I should be healed enough to do all my normal activities (including riding) in about 6 months, so I won't miss much of next year's riding season. That also gives me all winter to figure out the bike situation.

Sorry to hear that Jason, man that sucks. Glad you are relatively ok and no permanent damage.
Bikes can be replaced, but it is still sad to see your new baby damaged.
Hard to believe that many people with no license or insurance are still on the road. Any news on what is going to happen to him?

According to the police report he was only cited for driving without a license and driving without proof of insurance. I would guess he will get away with some fines and nothing else :-/

Here in MA cop cars have laser guns all over them that can read and run something like 300 registrations a minute . If your sticker is out of date and your within visible distance of the cop car , your busted . Same goes for unregistered , too many parking tickets , expired license , no insurance , you don't stand a chance of getting away with anything in this state . At least here if someone runs you over , they more then likely have insurance .

JasumX, whauw .... Sad story, but you are so lucky to have no permanent body damage, 6 months is a long time mate, and hopefully no pain ....

Your health is the important part, please keep this thread going with info about your health and insurance, etc ??

In Minnesota the car has to have insurance. Not the driver.
Do as the doctor says so you can heal. As for insurance just tell them to talk to your lawyer. Insurance will try there best to end your case fast as they can. They don't like ongoing cases.
Hope your bike is totaled so you can ride a 16 hope you have someone that will shovel for you if you don't tell insurance company to send someone out to do it.

Glad your injuries are not worse! The bike can be replaced. Don't give a statement to anyone from insurance. Look up Hupy law firm. They are based in Wisonsin but I'm sure they work in Minnesota too. Some of the best lawyers bar none for motorcyclists in the area. Milwaukee Personal Injury Lawyers | Hupy and Abraham, S.C.. Although after looking at their website is shows nothing about your state. You can also check AIM Richard Lester attorney or The Law Tigers. Whatever you do get yourself a good MOTORCYCLE attorney.

This sucks for you Jason, I was out shopping for my kids yesterday and jeans cost a fortune ..... :wink

Jason, the number one thing to take out of all this is; you're still above ground, no dirt nap for you. The CC, it's just a motorcycle, metal, bits of plastic and rubber and can easily be replaced. Not so with you. Sounds like the insurance is gonna be a major pain in the a$$ and as much as I hate to say it IF there's ANY doubt as to the validity of the other party's insurance lawyer up now. Find a good one, not one of those shysters that advertises on late night TV, they're all about the 15 min phone call and a third of the settlement.

I'm glad you walked away and now your number one priority is to heal up so you can be with family and friends, and last is getting the insurance and motorcycle squared away.

Sorry to hear about the crash....sounds like there was nothing you could have done to avoid it - we can't read the minds of cagers unfortunately.
I have uninsured driver insurance on all my vehicles. We have alot of migrant workers around here in the winery and fruit & nut groves - I've been with State Farm for over 20 years and have always been very happy with their service both home and vehicle. If your insurance is difficult to deal with consider SF after you resolve this case.

Man sorry to hear about the crash.... I know I would be hot if my bike got hit, (Oh, been there before this year) but like all have said. Glad you are not hurt that to bad.

Hope you heal fast with no effects from the wreck! I assume you have uninsured motorist insurance?

I hope you heal quickly

A burst fracture of the vertebra will require monitoring. Don't try to push it and find a good neurologist to review you and pictures.

I just spent 3 months in a Miami JTO brace myself after a drunk driver crashed into me. I hope that you are younger than me because it takes time for old bodies to repair.

Fortunately I have a friend who specialises in compensation law, she is making life easier for me.

I actually do have State Farm and have only had to use my insurance once before thankfully. I do have uninsured driver coverage, so it seems pretty clear cut to me. Unfortunately the first couple times I talked to them they said "oh, well you don't have medical coverage on your policy..." Eventually I had to spell it out to them that I wasn't at fault and the other driver's expired insurance card was also State Farm. Either way they are on the hook whether they know it yet or not. I'd prefer not to involve lawyers, but I do have a friend of the family who is a lawyer waiting in the wings if need be.

Motoprimo has the bike and will likely be getting the estimate together this coming week.

It's been a bit of a struggle keeping with the Doctor recommendations (10 pound lifting restriction is really grating...). I do have a wonderful girlfriend who yells at me whenever she suspects I'm bending the rules. It's probably for the best :) . My first follow up with the neurosurgeon is Monday and I'm hoping he might ease up a bit. We shall see.

Paranoid stoners possibly dont commit real crimes and are easier to control in a sheep herding manner.....could that be the lawmakers reasoning....I was in Nimbin yesterday, youve heard of Nimbin? Probably nothing like Massechusets or MA cos its easier to spell, but Nimbins possibly the only town in Australia where a person would be cool to openly smoke a joint or a bong.
Alcohol and other drugs are fairly rife too.
Cops here have the technology for roadside drug testing and lots of them have license plate recognition capability.
