So I am posting this here for everyone to see because I know he does mail in work as well. The really short story is after 3 months of waiting for my bike he ripped me off. I paid him $5180 upfront for repair of some minor damage to my bike a paint job and to order some parts to be bolted on. After 2 months with horrible communication and no proof of any work done or parts oredered I started to get on him for updates and a projected finish date. He tells me he should be done in roughly a week. The first week goes by and he tells me he was unable to get in touch with me because his phone broke. I went down to the shop mid week talk to the guys next door and find out he went to SEMA. So he tells me when he gets back that oh yeah he went to SEMA but just over the weekend, I find out he had a booth was there all week. Flags are starting to go up in my head at this point. The next week goes by I dont hear anything on Friday he tells me it will be done Wed before Thanksgiving. Wed comes around he tells me the paint had a reaction with the clear and the clear didnt dry because it was so humid he would have it for me Mon. I meanwhile call a friend of his to ask if he can do a little probing and see whats going on. I find out the whole week he was gone in California. Monday comes by he tells mehe isnt done yet it is going to be another week. I demand pictures of my parts and receipts. The guy sends me a picture of my parts but nothing that was supposed to be ordered is in the picture. I told him that I wasnt an idiot and I wanted to see my fairing and my exhaust, no answer. The next week rolls by Monday he tells me it might be done Tuesday. Tuesday comes he tells me that he still has allot of color sanding and buffing to do and it will be another 8 hours of work plus assembly so realisticly Thursday. I say ok no problem Thursday comes he tells me he is sick so the work is slow going and it wont be until Friday. At this point I am like whatever man get my bike back to me. Friday turns into Saturday I dont hear from him so I think everything is good 30mins before I leave my house he tells me he is in the hospital sick. I let him know I hope everything is ok. A couple hours go by and I call him and the story changes to he is at a urgent care clinic and he will let me know when he is out. Cool I tell him I am ready to get the bike and be done with this. All day passes I call him at 6 he tells me he is going to stay overnight at the urgent care clinic and I am like wtf thats not how it works, I am in the medical field and I know he is full of BS at this point so I call him out on it. He ignores me and tells me he will have a friend get the shop open so i can get my bike. Two hours go by he text me my bike is outside his shop sitting by the roll up doors. I text him wth etc why didnt he let me know what was going on so i could be there to get it. Again he ignores me and states his friend didnt give him any notice blah blah. I go get my bike find it in pieces still and the paint job has not been color sanded or buffed and some parts have no clear at all. None of the ordered parts are there and I have no repairs made and actually more damage. The only thing I got was my bars and they were not even the ones I had ordered so I am assuming i some other poor guys bars. Anyway I get her home find more issues and the guy is telling me that he doenst want to deal with me because he is sick and it is Sunday. I get nothing from hi as far as any plan to make things right just that everything outside was all he had.







So now I have another shop salvaging the paint job as best they can and i am out all my ordered parts and a Left bin i paid for. In total he was given $5180 I had a list of $2600 in parts leaving him with a healthy sum of $2580 for the paint job. Instead i am getting zero parts and another bill from another shop fixing the work, and in the end although the art work is good the clear and job itself sucks. I am wasting time trying to find a lawyer so he take more ofmy money to try and teach this guy a lesson. So this is my Christmas present this year and what I get before the hoidays Merry Christmas hope you guys stay clear and warn your friends.

Why would you, or anyone, pay anyone IN ADVANCE for work yet to be done? If you listen to those call in financial advice talk shows, there's a parade of fools calling with stories just like yours--the situation is the same, the names are different.
I'm not an attorney, but it looks like your only recourse is small claims court. Its inexpensive and no attorneys are allowed. Its your word against his, so take a ton of paperwork, receipts, photos and witnesses into the courtroom. That's a tough lesson learned. If money is requested before work begins (with some exceptions) that's a big red flag. I'd be looking for another source.

Wow! Trust no one. It appears that this guy may have a serious problem. Could be drug related. Either way he owes you. Don't lay down on this. Small claims court is your only choice here. Any other way to deal with this would be illegal. Sorry it happened to you. Lesson learned right? Now prepare yourself to do the right thing and take this asshole to court. Merry Christmas

Slick, if your guess is right and the perp has a drug problem, the money may well have gone to the guy's dealers. Our boy will have a zero to none chance of getting anything even if he wins. I hope this thread gets a lot of peeps, so more will take heed and avoid what Frank is dealing with.

Small claims court is out in AZ the limit is $2500. Also I never would of paid in advance but my insurance company cut the check to the shop so he got it all upfront. In fact I bought 2k in parts so it would make up the difference in the budget he needed for paint. I learned a lesson I never had to use before and that is a written contract instead of a open end date. I definitely agree it sounds like a possible drug issue. We do have a thing with our local news channel called 5 on your side and I contacted them as well. I would like to do everything I can to ruin his possible chance of future business. I do plan on taking him to court no matter what even knowing I'll never see very much of anything in payment. I did get allot of good info from the office I talked to today so things are moving another appointment tomorrow.

Another lesson; have insurance checks made out to you. In most states, you can choose when and where repairs are to me made and a check in hand is to your advantage.

Seems to me that your insurance co lawyers may have a vested interest in this outcome. Let us know how it all comes out.

I wish, I have Geico and asked for this option but they wouldnt ok it. They said this was there way of making sure the bike got repaired

I agree, sounds like you need to have your insurance company deal with it. If they cut the check then they are the ones legally who have paid for the repairs and they should be the ones who insure that the work is done. What you paid extra for parts that were not on the bike before or a custom paint job will be your problem. Good luck.
