Well it was bound to happen.....I got my first noise violation ticket tonight. Funny thing is though.....my bike was SHUT OFF and parked when one of Edmonton's "finest" pulled up and asked us for our papers. They then proceeded to ask if I had ever been tesed for the noise bylaw.....I was honest and said "no". So after a half hour of them [email protected]*cking around trying to get their handheld tester to get the reading they wanted they pulled out the big tester and set up. I passed at idle but was 7db over at revs. They check you at 1500rpm......but my bike doesn't have a tach.....hmmmmmmm!
Any way....I got a laugh out of the dog and pony show and I WILL be fighting the ticket. There are so many holes in what they did and how they did it, I shouldn't have too much trouble getting this one thrown out.
This is an ongoing issue here in our city that is only getting worse.....but of course it's not a cash grab.......:soapbox:

If your bike was turned off, why did you start it? They can't make you start it. You could be just pushing it around for all they knew. :)

Now you learned your lesson about being honest. Next time, say they've been tested, and they passed.

The noise police are everywhere nowadays. There are so many bikes on the roads now that some people are to the point where they want something done about it. Mostly on popular riding roads. The people who live along these nice riding roads or destination spots for bikers are getting much more vocal in their opposition to the loud pipes.

It wasn't a big deal when there were so few of us but now...just inevitable I guess.

Good luck on beating the ticket. Doesn't "sound" like you were much over the limit anyway.

Unfortunately saying I have passed a test will get me nowhere either. Here they do NOT keep records of tests.....so even if I had been tested and passed they have the right to test me again. Thats what the big fight is up here right now. The bylaw is VERY discriminatory.
I guess I could have fought them on it and refused to start the bike but that would only lead to more trouble.....I don't need that! LOL.
There is a group that fights tickets and has been very successful in geting many of them thrown out.....I will gladly fight this and hope for a positive outcome!

I thought that they put that bylaw on hold for this year until they got it all 'fixed' so it can't be fought and lost in court so easily.
It's just stupid if you ask me, there are more annoying noises out there.
Last year Edmonton's finest tried giving me a ticket, I'm from out of province, I knew about their bylaw but played stupid. I told them that I'm passing through and my city has no problem with my pipes, so if you do, take it up with them. I like being the tourist

One of my favorite day trip destinations just enacted noise limits (Lake Lure NC). They are also cracking down on parking for bikes.

I was really disappointed to read this post... I had been hoping that the Swepts would have been under the limit. Best of luck - I hope you get it thrown out!

Did they give you any grief on the side mounted plate?

Yes I did get a ticket for the plate as well. $115.00
The statute in the trafic safety act says that the plate must be securely attached and not obscured. So it comes down to the officers discrection as to what HE feels is "obscured" There is no ruling on wether the plate is horizontally or vertically mounted. Standing behind the bike (or while riding in a police car as where this law comes from so they can see it) you can see the plate clearly, There is also no ruling on what degree of angle the plate must be visible from either. So I will fight that one as well....wont holt my breath there though.

The pipes were legal at idle but came in at 7db over the limit in the rev test. Now the ruling on the testing equipment says it is registed as 95% accurate (calibration test) so in final numbers you have to minus 5% from the total reading. That puts me at 1.85db over the limit not counting the ambient db reading in the area where the test was taken. The office did not minus the 5% nor did he reveal to me the reading of the ambient noise prior to doing the test. Those two items there are reason enough to get the ticket quashed. I will let you all know what happens as things progress. I have sent an email to the prosicutor requesting disclosure so I will see what the officer wrote in his report....if he did one.
